Purpose and acceptance

These terms govern the purchase and use of a Strate software license or subscription, published by name of the SAS (“Strate”). They apply to every customer, whether a consumer or a business, and are accepted when subscribing.

The service

Strate is a desktop application for analyzing futures markets, available in beta for macOS (Apple Silicon) and Windows x64. The service evolves: features may be added, changed or removed, especially during the beta.

Market data is not included. Live data and trading require Rithmic access, and replay with order book depth requires Databento files, both obtained by the customer from those providers.

Account and device

• Subscribing requires a Strate account. The customer is responsible for keeping their credentials confidential.
• The license is personal and is used on one active device at a time. The customer can switch devices from their customer account.
• Sharing an account or license is prohibited and may lead to access being suspended.

Prices and early adopter offer

• The Early Adopter offer is a lifetime Strate license at €199 (£199 or $199 depending on the currency), paid once and reserved for the first 500 customers. It has no monthly subscription.
• After the first 500 customers, the price is €49.90 (£49.90 or $49.90) per month.
• For monthly subscriptions, after cancellation a new subscription is taken out at the price in force at that time.
• Prices in euros and pounds include taxes. Prices in dollars exclude taxes: any applicable tax is calculated at checkout based on the customer’s address. to be confirmed with your accountant

Payment

• Payment is made by card through Stripe, a payment provider. Strate has no access to full card details.
• The Early Adopter license is paid for once. The standard monthly subscription is charged every month on its renewal date. If a payment fails, it is retried; if it is not settled, access to the application may be suspended.
• Invoices are available in the customer account.

Term and cancellation

• The Early Adopter license is granted for life, with no monthly renewal. The standard subscription runs for one month and renews automatically.
• Customers with monthly subscriptions can cancel at any time from their customer account, in a few clicks. Cancellation takes effect at the end of the current monthly period.
• Strate may terminate the subscription in the event of a serious breach of these terms, after notifying the customer.

Withdrawal and refunds

Consumers normally have 14 days to withdraw. Under Article L221-28 of the French Consumer Code, this right can no longer be exercised for digital content not supplied on a physical medium once its performance has begun with the consumer’s express consent and their waiver of this right.

When subscribing, the customer may request immediate access to the application and acknowledge waiving their right of withdrawal. Without this request, they may withdraw within 14 days of subscribing and be refunded.

For monthly subscriptions, outside these cases, months already started are not refunded. any goodwill refund policy to be specified

Use and risks

• Strate provides visualization and measurement tools. It provides no investment advice, signals or guaranteed results.
• Trading futures carries a high risk of loss, which may exceed the capital invested. The customer remains solely responsible for their decisions and orders.
• Execution features (orders, protections, risk controls) depend on the connection to market services. They guarantee neither an execution price, nor the absence of losses, nor protection while the application is stopped.

License and ownership

Strate grants the customer a personal, non-exclusive and non-transferable right to use the software for life for an Early Adopter license, or for the duration of a standard monthly subscription. Copying, decompiling, modifying or reselling the software is prohibited, except within the limits allowed by law.

Availability and liability

Strate is offered as a beta: interruptions, bugs or data loss may occur. The customer keeps their own backups.

Strate’s liability is limited to direct and foreseeable damage, up to the amounts paid by the customer over the last 12 months, except in case of gross negligence or wilful misconduct and within the limits allowed by law.

Creator Program

A creator code entered when signing up does not change the price paid by the customer. Taking part in the Creator Program is governed by specific terms. program terms to be drafted

Changes to these terms

Strate may change these terms. The customer is informed by email at least 30 days before a significant change takes effect and may cancel before that date.

Mediation and governing law

In the event of a dispute, consumer customers may refer the matter free of charge to the consumer mediator: mediator’s name and contact details.

These terms are governed by French law. Consumers keep the protection of the mandatory provisions of their country of residence. Contact: contact email address.
